The Council of Europe has just issued a report on alleged illegal detentions and rendition flights on European territory. Based on official replies received by all 46 member states, the report highlights the lack of legal provisions ensuring effective oversight of activities by foreign security services. ''Immunity cannot mean impunity'' said Mr Davis, ''Exceptions to state immunity already recognised in the case of torture should be extended to other serious violations of human rights such as enforced disappearances''. His report also reveals that existing procedures to monitor flights through European airspace do not provide adequate safeguards against abuse.
The reports follows a questionnaire sent by the Secretary General of the European Council to all country members in which states were asked to explain how their internal law 1)controled acts by foreign agents in their jurisdiction, 2)safeguarded the detention and kidnapping by foreign agents of people in their jurisdiction, 3)responded to infrigements of European Human Rights convention rights, in particular detention by foreign agents and 4)whether any public official had been involved in the detention or transport of detainees to foreign agents.
While all countries replied, Albania did not answer any of the questions. Other countries were also very vague in their answers.
